Criminal Sexual Contact

James Fitzgerald, age 38, has been convicted for Criminal Sexual Contact of a minor (child under 13), a 2nd degree felony.

On June 16, 2021, San Juan County Sheriff’s Office deputies received a report that James Fitzgerald had inappropriately touched a child on several occasions the previous year, but the parent had just found out about it.  Due to the age of the child, the case was referred to detectives and a safehouse interview was conducted on June 21.  Based on the interview, SJCSO Detectives charged Fitzgerald with 3 counts of Criminal sexual contact of a minor (child under 13)(unclothed) - 2nd Degree Felony.  He was also charged with Contributing to the delinquency of a minor - 4th Degree Felony for showing the child pornographic videos.

On September 22, 2022, Fitzgerald entered a plea deal and was convicted on 1 count of Criminal Sexual Contact of a minor (child under 13).  On October 13, the judge sentenced Fitzgerald to 7 years in prison, after which he will be placed on parole for five years to natural life, and will be required to register as a sex offender for the remainder of his life.
